Special Needs Trusts

Foster S. Goldman, Jr, in our office is the attorney who argued the case of Lang v. Commonwealth, a decision of the Pennsylvania Supreme Court which changed the law in Pennsylvania, to enable parents of children with disabilities to plan their estates to establish discretionary trusts in such a way that state aid may, if desired, be utilized without necessarily dissipating the trust assets. The Special Needs Trusts which were permitted by that case, and subsequent cases, some of which were also argued by Mr. Goldman, require careful drafting, and our firm is very proficient in preparing such documents, either as part of an estate plan, or as a living trust.
